Abstract:
In light of the recent incident at the Yerevan City Hall related to the sewage problem in the Nubarashen district, many discussions have been raised in light of issues which concern an entire community and group of people collectively. Ms. Marina Khachatryan who is an opposition municipal legislator, tried to demonstrate a sample of contaminated water to Yerevan’s Mayor Taron Margaryan in order to inform him and other council members of the gravity of the council members attacked Ms. Khachatryan and the police had to intervene to stop the brawl. The thesis which will be developed, touches upon a procedural tool which facilitates and to some extent ensures effective redress before the courts for cases which involve multiple plaintiffs dealing with a violation of their rights of the same nature. Subsequently, this paper will try to answer questions such as whether there are legal means to raise issues tantamount to the above mentioned example in the judicial system in Armenia, if so what are the limitations and finally, how can the implementation of a new tool called “Class Action” help resolve such problems.
